Changes have been made in the declaration of conformity

GNCC has reflected changes made in the Georgian law “on Broadcasting” in the forms of declaration of conformity.

According to changes that entered into force starting month of July, licensing/authorization in the field of broadcasting in Georgia is prohibited for a foreign political party or for its official. Also, for the legal entity interdependent with an administrative body of a foreign country, its official and public servant, except as defined by international agreements.

In accordance with Article 371 of the Georgian law “on Broadcasting,” license/authorization seeker is obligated to enclose to license or authorization application the declaration of conformity stating:

a)Identification data of a license/authorization seeker;

b) data about license/authorization seeker’s head officials and bodies;

c) Proof, that license/authorization seekers or their beneficial owners are not entities defined in Paragraph 2 of Article 37 of the Georgian law “on Broadcasting”;

d) Information data regarding license/authorization seekers beneficial owners’ identifications and owned shares;

 In accordance with Paragraph 2 of Article 37 of the Georgian law “on Broadcasting a license holder/authorized person shall not be:

a) an administrative authority;

b) officials or other employees of an administrative authority;

c) a legal entity interdependent with an administrative authority;

d) a political party or its officials;

e) a legal entity registered offshore;

f) a legal person with a share or stocks directly or indirectly owned by a legal entity registered offshore;  

g) a person, whose beneficial owner is an entity of a different state as defined by the current Paragraph or sub-paragraph d).
